Terms & Conditions for Mobile Mail

1. This is an agreement between you and Cable & Wireless related to your use of Mobile Mail. The agreement consists of the following terms and conditions as well as the Cable & Wireless Terms & Conditions for Mobile and Internet service. By your use of Mobile Mail, you are deemed to have consented to all of these terms and conditions.
2. Use of Cable & Wireless Mobile Mail. You are not to use Mobile Mail for any unlawful or abusive purpose, including but not limited to any use which disrupts Cable & Wireless' system or other customers, damages Cable & Wireless' property, or interferes with Cable & Wireless' ability to provide service to customers. You agree to comply with all laws while using Mobile Mail and you agree not to transmit any communication that would violate any laws, court order or regulation or would likely be offensive to the recipient. You are responsible for all content you transmit through Mobile Mail.
3. Privacy. Cable & Wireless will not be liable for any lack of privacy you may experience while using Mobile Mail. Cable & Wireless has the right to intercept, disclose, or delete any messages sent through Mobile Mail in order to protect its rights.
4. Limitation of Liability. UNDER NO CIRCUMSTANCES WILL CABLE & WIRELESS BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER THAT ARISE FROM YOU OR ANY USERÅfS USE OF MOBILE MAIL. CABLE & WIRELESS IS NOT LIABLE FOR ANY ACT ASSOCIATED WITH THE PROPER EXERCISE OF ITS RIGHTS UNDER PARAGRAPHS 2 AND 3 OF THIS AGREEMENT.
5. No Warranties. CABLE & WIRELESS MAKES NO EXPRESS WARRANTY REGARDING THE SERVICE OF MOBILE MAIL AND SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. CABLE & WIRELESS DOES NOT AUTHORIZE ANYONE TO MAKE A WARRANTY OF ANY KIND ON ITS BEHALF AND YOU SHOULD NOT RELY ON ANY SUCH STATEMENT.
6. Agreement. You acknowledge that these terms and conditions are a material part of Cable & Wireless' decision to provide Mobile Mail service to you.
